The data retention bill is in conformity with the constitution

Wrong. The introduction of data retention in Germany violates the fundamental constitutional rights of the citizens concerned as well as the associated decisions of the Federal Constitutional Court.

"Der Grundsatz der Verhältnismäßigkeit führt dazu, dass der Gesetzgeber intensive Grundrechtseingriffe erst von bestimmten Verdachts- oder Gefahrenstufen an vorsehen darf [...] Verzichtet der Gesetzgeber auf begrenzende Anforderungen an die Wahrscheinlichkeit des Gefahreneintritts sowie an die Nähe der Betroffenen zur abzuwehrenden Bedrohung und sieht er gleichwohl eine Befugnis zu Eingriffen von erheblichem Gewicht vor, genügt dies dem Verfassungsrecht nicht."

Eine Vorratsdatenspeicherung verzichtet auf jeden Verdachtsgrad und auf jede Nähe der Betroffenen zu den aufzuklärenden Straftaten, stellt gleichzeitig aber einen schwerwiegenden Grundrechtseingriff dar, weil sensible Daten über das Kommunikationsverhalten der gesamten Bevölkerung gesammelt werden. Dies ist mit dem Verfassungsrecht unvereinbar.

In einem Urteil des Bundesverfassungsgerichts vom 12.03.2003 heißt es: "Insofern genügt es verfassungsrechtlichen Anforderungen nicht, dass die Erfassung der Verbindungsdaten allgemein der Strafverfolgung dient. Vorausgesetzt sind vielmehr eine Straftat von erheblicher Bedeutung, ein konkreter Tatverdacht und eine hinreichend sichere Tatsachenbasis".

Mit diesen Vorgaben steht die beabsichtigte Vorratsdatenspeicherung im evidenten Widerspruch. Mit der Vorratsdatenspeicherung ordnet der Staat eine Erfassung und Vorhaltung von Verbindungsdaten an, die nur allgemein der Strafverfolgung dienen soll, aber keinen konkreten Tatverdacht und keinerlei Anhaltspunkte einer Straftat voraussetzt.

Schon 1967 hat das Bundesverwaltungsgericht entschieden: "Ausgangspunkt hat die Feststellung zu sein, daß nach dem Menschenbild des Grundgesetzes die Polizeibehörde nicht jedermann als potentiellen Rechtsbrecher betrachten und auch nicht jeden, der sich irgendwie verdächtig gemacht hat ('aufgefallen ist') oder bei der Polizei angezeigt worden ist, ohne weiteres 'erkennungsdienstlich behandeln' darf. Eine derart weitgehende Registrierung der Bürger aus dem Bestreben nach möglichst großer Effektivität der Polizeigewalt und Erleichterung der polizeilichen Überwachung der Bevölkerung widerspräche den Prinzipien des freiheitlichen Rechtsstaates."

Die Vorratsdatenspeicherung geht weit über die Aufnahme vom Lichtbildern und Fingerabdrücken im Rahmen einer erkennungsdienstlichen Behandlung hinaus. Sie betrifft sensible Daten über die Kommunikation der Menschen mit ihren nächsten Angehörigen sowie mit Beratungs- und Hilfsberufen, über die sozialen Beziehungen der Menschen zueinander, über ihre Internetnutzung und über ihr Bewegungsverhalten. Eine derart weitreichende Registrierung des Verhaltens aller 82 Mio. Menschen in Deutschland aus dem Bestreben nach möglichst großer Effektivität der Polizeigewalt und Erleichterung der Verfolgung von Straftaten widerspricht den Grundprinzipien des freiheitlichen Rechtsstaates.

Mit Beschluss vom 22.08.2006 hat das Bundesverfassungsgericht an den Gesetzgeber nochmals eine besondere Warnung gerichtet: "Das Bundesministerium der Justiz hat mitgeteilt, seit längerem an einer Gesamtregelung der strafprozessualen heimlichen Ermittlungsmaßnahmen zu arbeiten [...] Es stellt sich auch die Frage, ob und in welchem Umfang von einer neuerlichen Ausdehnung heimlicher Ermittlungsmethoden im Hinblick auf Grundrechtspositionen unbeteiligter Dritter Abstand zu nehmen ist." Die Vorratsdatenspeicherung stellt eine schwerwiegende Ausdehnung der heimlichen Telekommunikationsüberwachung dar und beschädigt Grundrechtspositionen unbeteiligter Dritter massiv.

Vor dem Hintergrund der klaren verfassungsgerichtlichen Rechtsprechung ist es ein vorsätzlicher Verfassungsbruch, eine Vorratsspeicherung von Telekommunikations-Verkehrsdaten gleichwohl zu beschließen.

Security authorities of many European and non-European states work successfully without the preventative storage of meta-data (e.g. Austria, Greece, Norway, Romania, Sweden, Australia, Canada, Japan). Nobody can argue that the internet is a lawless space in those countries.

The clearance of internet crimes is possible without data retention with a probability of 80%. This is due to the wide usage of flat rates on internet services. With these services internet connections are hold up for a long time which allows authorities to track suspicious connections. If this is not successful, authorities are then able to track the connection when the internet user connects to the service once again.

Due an increase in usage of internet flat rates there is less connection data available to investigative authorities today in comparison to the time before the start of data retention programs

Wrong. Each year investigative authorities get hold on more meta data.

In the field of telecommunications mainly the internet services are offered as flat rates. In 2008, hence before the data retention of internet connections came into effect, already 86% of internet users used flat rate offers.

The obligation of data retention got legal validity in the field of internet on 01.01.2009. Before that day, browsing history was not saved or only up to seven days. This is currently the case again. Up until the 90s when no points of exchange existed hence no meta-data. This fact did not prevent any criminal persecution.

During the current information age, people make more and more use of digital communication instead of personal letters and conversations. This has led to a constant increase of available communication data. Even if in specific cases the available amount of meta data has decreased the overall loss of information is redundant. This is due to the many additional rights gained by the authorities to retain data by other means of observation.

Lawyers, pastoral caregivers, and members of parliament are excluded from data retention

Wrong. All connections of people in these professions will be collected and retained.

Only the retrieval of such data will be banned. Though this ban is only valid under two premises. Firstly, the data at hand must be part of a professional secret. And secondly, the owner of the data cannot be a suspect of crime. In reality it is oftentimes extremely difficult for the police to distinguish whether the data falls under the two premises or not. For instance, it is extremely difficult for the police to determine while retrieving connection- or movement data which

In addition, the ban of data retrieval does only hold for criminal persecution. Inquiries by secret intelligence services and preventative inquiries by the police are allowed at all times.

The decision of the Federal Constitutional Court of Germany (FCCG) is an appropriate compromise

Correct. With the court finding of the FCCG only a targeted surveillance of suspects is legitimate and lawful. The storage of meta data generated by millions innocent people, on the other hand, is forbidden. This finding incorporates a compromise which has been successfully proven in many countries all over the world.

With the court sentence of March 2nd, 2010 the FCCG nullified the regulations for the mass data retention in Germany. The regulations of such data retention had been against the German Basic Law, so the courts reasoning. However, the court made clear that a law-abiding general retention of communications data is still possible under certain conditions. Firstly, the security measures to store the data must be increased. Secondly, there need to be stricter requirements for the authorities to access the data. Finally, relationships of trust (e.g. with lawyer, psychologist, etc) must find special protection. Nevertheless, such a „retention of data 2.0“ like described above would be still unacceptable. During the course of such retention sensitive data of more than 80 million citizens would still be collected. That would include social relationships (including professional and business relationships), movement data and data of private situations in life (e.g. contacts to doctors, lawyers, work councils, psychologists, and counsels). With such a set-up of data retention professional secrets by lawyers, doctors, psychologists, and counsels would be violated. Further, this set-up promotes leaks and a misuse of data which undermines the protection of journalist's sources and hence the freedom of press. In conclusion, an untargeted retention of data damages our free and democratic society.

The refusal of all retention of data is a fundamental and extreme position

Wrong. It is the other way around. A full retention of connection data of all citizen without any reason is a radical and extreme position.

The German Basic Law originally forbid any intervention in the secrecy of telecommunication by any authority. However, in turn with the German emergency law from 1968 judges have been able to demand the recording of all telecommunication of persons who were suspected for a crime. Also federal prosecutors received the right to demand such recording in exigent circumstances (i.e. imminent danger) without an approval of a judge. In comparison to this, the idea of a general retention of data without any approval of a judge nor any suspicion of crime or even imminent is an extreme position. It means that the entire population is recorded on who, when and with whom they communicated. Further, it means where citizens used or only carried their cellphones and how they used the internet. This complete storage of data would be a position as extreme and radical as a complete ban on any such data. The procedure that only judges and federal prosecutors have the right to demand a recording of telecommunication data of suspects or imminent danger is therefore a long practiced and constitutional compromise and hence no fundamental nor extreme position.

The cohabitation in a democratic society demands differentiated views

Correct. This is why an undifferentiated retention of telecommunication data of all citizen, may they be suspects or not, is in a democratic society not acceptable.

The refusal of any data retention without a constructive counterproposal is not worthwhile

Wrong. Our civil liberties are not negotiable.

As opponents of data retention without any suspicion or immediate danger we do have proposals (LINK) which facilitate criminal persecution. These proposals include means of fast data storage, better education and equipment, prevention of crimes through data and consumer protection. If effective criminal persecution is the goal, such organizational and legal measures are of utmost importance. Hypocritical debates, on the other side, about date retention will distract from failures in the means of protection of citizen.

A European ban on any form of data retention has no majority

Wrong. As long as the European commission submits no proposal including a ban on any form of data retention it is not clear whether a majority is in favor or in opposition to this motion.

Even if there is no majority behind a proposal which is against any form of data retention it does not mean that there is a necessity for data retention without suspicion or immediate danger. The European Union could instead leave it up to the national parliaments and constitutional courts if the entire telecommunication should be recorded without a suspicion or not. Many civil society organizations have already proposed.

Provider of telecommunication services partly store data considerably longer than certain proposals on the reintroduction of data retention suggest

Correct. The focus must be on the word „partly“ though. Everybody, according to law, can prevent the recording of telecommunications data by choosing a flat rate. For many people who rely out of personal or professional reasons on confidential telecommunication or people who want to protect their privacy this choice is of utmost importance.

A quick freeze without retention of data is impossible. Data which is not stored, cannot be frozen

Wrong. A procedure for a quick storage („Quick freeze“) of telecommunications data requires no general retention of data.

An order on storage creates the opportunity for persecutors to save existing telecommunication data which would have been deleted otherwise. The data at hand would then only be released if all legal requirements have been met. A judicial permission to store and use the data for persecution would be an example of such requirements.

With an order of storage recording of data of the specific connection possible. Even without the general retention of data backtracking is possible with the ongoing connection at hand. Since connections out of flat rate services usually are stable over a long period of time an identification of the user is even easier compared to other crimes. Long after the crime has been committed the perpetrator can be identified. In offline crimes the perpetrator would have left the crime scene already.

An order of storage is even possible after the connection has been resolved. Certain data saved out of professional reasons (e.g. for accounting reasons). This data storage takes place in Germany up to six month.

It is correct that unsaved connection data cannot be „frozen“ nor be released to the authorities. This is not a disadvantage though. It guarantees the indispensable requirement of confidential and unselfconsciousness of citizens who are almost 100% fair.

The Federal constitutional court discarded the method of „quick freeze“ as an alternative to the general retention of data

False. In no case, the federal constitutional court has discarded the method of „quick freeze“ as an alternative to the general retention of data.

The federal constitutional court decided that the government is, in accordance with the German Basic Law, allowed to declare a general retention of data as a necessity with the reasoning that a targeted collection of data in not as effective as a global and all-inclusive data retention. The constitutional threshold to declare something as a necessity is extremely low. Even a single contravention which can only be persecuted with a general data retention is enough to reach such threshold. Even when more crime is solved without this retention of data the government can lawfully engage in the retention of data.

The minimal constitutional threshold for such an undertaking cannot be the basis for an debate on the necessity and proportionality of a global data retention. Politically, it is by far more important that no space develops on the internet outside the jurisdiction. Additionally, internet crimes need to be solved as effectively as crimes outside the internet. This is, as explained above, also within reach without a global retention of data.

A date retention for one or two weeks ('Quick Freeze Plus') would be an adequate compromise

Wrong. A shorter period of time of data storage would not change the fatal consequences of a general retention of data.

Any record of communication or connection puts confidential relationships (e.g. to journalists, counsels, lawyers, or business partners) on the line of getting public through data breaches or misuse. On top of that a recording of connections bears a permanent risk that innocent people appear as suspects of crimes. This could lead to apartment searches and interrogations as the connection data only identifies only owner of the internet connection and not the user.

The permanent risk of experiencing disadvantages which comes along a permanent recording of communication data creates a strong deterrence and prevents an unselfconscious use of telephone and internet during sensitive situations (e.g. anonymous information of journalists, anonymous expression of opinion, confidential exchange of professional secrets, confidential coordination of political protests, psychological, medical, and judicial counsel and support groups of people in special situations like emergencies and illnesses). If innocent or dangerous people cannot seek help without fear of experiencing disadvantages, a meaningful prevention will not take place and the life of innocent people will be at risk.

The allowance of a general data retention will be a huge step-stone towards a surveillance society. The storage of data for potential use by the authorities would slowly capture all areas of life, because the record of personal data is useful for them in many ways. If the government allows the permanent record without suspicion of all actions of its citizen, the records will include all areas of our life to an even by the German Democratic Republic unprecedented level.

'Quick freeze' practically opens the investigative authorities the opportunity to retain all data on suspicion at all times because the development and outcome of cases to be investigated are not foreseeable

Wrong. Orders to 'quick freeze' data must include the specific identification of a connection. Therefore, the possibility of a general retention of data through the back door is averted.

Due to technical reasons internet providers must know during an ongoing connection which IP-address is associated to which internet connection. To store this information in a case of suspicion no general retention of data is necessary. “Quick freeze” entails a recording of data from an ongoing usage of a certain service as well as all data generated by the connection in the future. (§ 100j Abs. 2 S. 3 StPO-E). Also law enforcement agencies are to pay at least 30 Euros per subscriber. All of this prevents excessive numbers of requests.

Soweit eine Sicherung mangels Datenspeicherung nicht möglich ist, muss einer entsprechenden Anordnung auch nicht Folge geleistet werden.

Es genügt, dass seine Identifizierung zur „Erforschung des Sachverhalts“ erforderlich ist. Ganz ohne Verdacht einer Straftat ist eine Identifizierung von Internetnutzern „zur Abwehr von Gefahren“ und für Aufklärungszwecke der Geheimdienste zugelassen. Kein Richter kontrolliert vor der Identifizierung, ob ihre gesetzlichen Voraussetzungen vorliegen. Internet-Zugangsanbieter identifizieren jährlich über 3 Mio. Internetnutzer gegenüber Staat und Urheberrechtsinhabern.

Mithilfe von Aufzeichnungen (Logfiles) von Internetanbietern wie Google, Youtube oder Twitter können Behörden im Fall einer IP-Vorratsdatenspeicherung nicht nur lange nach Abschluss der Internetsitzung herausfinden, über welche Anschlüsse vermeintlich verdächtige Internetseiten gelesen, ungewöhnliche Videos betrachtet oder auffällige Meinungen geäußert wurden. Mithilfe von Referer, Cookies, Identifier oder Benutzerkonten kann nach einer Identifizierung oft auch festgestellt werden, was der Betroffene sonst noch im Internet getan hat, teilweise über Wochen oder Monate hinweg. Die jeweils genutzten IP-Adressen ermöglichen dann auch die Erstellung eines ungefähren Bewegungsprofils. Mithilfe von IP-Adressen können zudem vermeintlich anonyme E-Mails rückverfolgt und vermeintlich anonyme Benutzerkonten zugeordnet werden.

Insgesamt würde schon die ernsthafte Sorge vor Nachteile infolge einer jederzeitigen Nachverfolgbarkeit in vielen Situationen eine unbefangene, freie Kommunikation unmöglich machen (z.B. anonyme Information von Journalisten per E-Mail, anonyme Meinungsäußerung im Internet, vertraulicher Austausch von Geschäftsgeheimnissen, vertrauliche Koordinierung politischer Proteste, psychologische, medizinische und juristische Beratung oder Selbsthilfegruppen von Menschen in besonderen Situationen wie Notlagen und Krankheiten).

In den meisten E-Mails ist die IP-Adresse des Absenders enthalten. Darüber konnten im Fall einer IP-Vorratsdatenspeicherung selbst vermeintlich anonym versandte E-Mails zurückverfolgt werden. Dies würde der Pressefreiheit und der Information der Öffentlichkeit empfindlich schaden.

Nach einer Untersuchung macht jeder fünfte Internetnutzer Fantasieangaben bei Online-Registrierungen, um anonym zu bleiben. Nach dem Vorschlag der Bundesjustizministerin könnten Staatsbeamte Sie künftig als Inhaber eines solchen "anonymen" Benutzerkontos über Ihre IP-Adresse identifizieren, unabhängig von Ihrem Internet-Zugangsanbieter. Anschließend könnte der Beamte von dem Internet-Diensteanbieter die früheren IP-Adressen, mit denen Ihr Benutzerkonto genutzt wurde, erfragen, um daraus ein ungefähres Profil Ihrer Bewegungen zu erstellen.

Nach einer Studie kann aus den von einer Person in den letzten Tagen benutzten IP-Adressen mit hoher Wahrscheinlichkeit abgeleitet werden, ob es sich bei den jeweiligen Standorten um das Zuhause, die Arbeitsstelle oder einen Reiseweg des Internetnutzers handelte.

Gelingt es Behörden über die IP-Adresse, einen vermeintlich anonymen Nutzer zu identifizieren, können sie sich von den Diensteanbietern mithilfe von Referer, Cookies, Identifier oder Benutzerkonten oftmals mitteilen lassen, was der Betroffene sonst noch im Internet getan hat, gegebenenfalls über Wochen oder Monate hinweg.

Die Sonderkommission "Mirko" der Polizei hat 2010 eine Internetseite mit Fotos und Informationen zu dem Fall ins Netz gestellt. Dabei ließ sie IP-Adresse und Zugriffszeit aller Leser der Seiten speichern. Durch Anfragen bei den Internet-Zugangsanbietern brachte sie in Erfahrung, über wessen Internetanschluss "häufig" auf die Seite zugegriffen wurde. Im Fall einer IP-Vorratsdatenspeicherung wären diese Ermittlungen ins Blaue hinein gegen Kunden aller Internetprovider möglich gewesen. Zurzeit kann man sich vor ungerechtfertigen Ermittlungen noch schützen, indem man einen Internet-Zugangsanbieter wählt, der die Zuordnung von IP-Adressen nicht auf Vorrat speichert (Anbietervergleich hier).

Auch das Bundeskriminalamt hat mehrfach gegen Besucher seines Internetportals ermittelt - ermöglicht nur durch die Vorratsspeicherung von IP-Adressen durch einige Internet-Zugangsanbieter. Bei Ermittlungen wegen der "militanten gruppe" fragte das BKA 417 IP-Adressen von häufigen Besuchern der entsprechenden Internetseite ab. Die Deutsche Telekom identifizierte 120 Anschlussinhaber, und das BKA unterzog diese Leser/innen einem "Hintergrundcheck", ohne jedes Ergebnis. Es handelte sich offenkundig bloß um interessierte Bürger. Weitere der vom BKA ermittelten IP-Adressen waren der Presse zugeordnet, hier hatten Journalisten recherchiert.

Mitarbeiter von Polizei und Geheimdiensten können auch private Betreiber eines Forums oder Blogs ohne richterlichen Beschluss um Auskunft ersuchen, unter welcher IP-Adresse ein Beitrag verfasst wurde, wenn dem Betreiber dies bekannt ist. Eine Vorratsspeicherung der Vergabe von IP-Adressen bei Internet-Zugangsanbietern würde anschließend Ihre Identifizierung als Inhaber des genutzten Internetanschlusses ermöglichen, gegebenenfalls eine Durchsuchung Ihrer Wohnung zur Sicherstellung Ihres Computers nach sich ziehen. Eine IP-Vorratsdatenspeicherung würde weithin das Ende anonymer Meinungsäußerungen in Foren und Kommentaren bedeuten.

Im Fall Holger Voss führte die IP-Vorratsdatenspeicherung durch T-Online dazu, dass Holger Voss wegen eines satirischen Kommentars im Heise-Forum über die Anschläge des 11. September 2001 wegen Billigung von Straftaten angeklagt und erst vor Gericht freigesprochen wurde. In der Folgezeit erstritt Holger Voss ein Urteil gegen T-Online, demzufolge der Anbieter die Zuordnung seiner IP-Adressen nicht speichern darf. Das Recht auf anonyme Meinungsäußerung im Netz ohne Furcht vor Rückverfolgung würde durch eine IP-Vorratsdatenspeicherung entfallen. Dabei machen sich 98% der Internetnutzer nie einer Straftat auch nur verdächtig.

"Laut Bundesverfassungsgericht stellt eine Vorratsspeicherung von IP-Adressen nur einen sehr geringen Grundrechtseingriff dar"

Falsch. Laut Bundesverfassungsgericht stellt die Identifizierung von Internetnutzern einen Grundrechtseingriff von "erheblichem Gewicht" dar (Abs. 258 des Urteils zur Vorratsdatenspeicherung).

Zwar hat das Bundesverfassungsgericht ausgeführt, eine Speicherung allein der Zuordnung dynamischer IP-Adressen hätte ein erheblich weniger belastendes Gewicht als eine nahezu vollständige Speicherung der Daten sämtlicher Telekommunikationsverbindungen. Dass eine auf den Internetbereich beschränkte Vorratsdatenspeicherung weniger eingriffsintensiv ist als eine Vorratsspeicherung auch von Telefon-, Handy- und E-Mail-Verbindungen, ist aber eine Selbstverständlichkeit. Das Bundesverfassungsgericht erkennt in seiner Entscheidung an, dass die Zuordnung einer IP-Adresse nicht mit der Identifizierung einer Telefonnummer gleichgesetzt werden kann. Da der Inhalt von Internetseiten anders als das beim Telefongespräch gesprochene Wort elektronisch fixiert und länger wieder aufrufbar sei, lasse sich mit ihr vielfach verlässlich rekonstruieren, mit welchem Gegenstand sich der Kommunizierende auseinander gesetzt hat. Werde der Besucher einer bestimmten Internetseite mittels der Auskunft über eine IP-Adresse individualisiert, wisse man nicht nur, mit wem er Kontakt hatte, sondern kenne in der Regel auch den Inhalt des Kontakts.

Weitere Argumente des Bundesverfassungsgerichts zu IP-Adressen sind von Datenschützern und auch von dem Bundesdatenschutzbeauftragten kritisiert worden. Laut Schaar stehen die Aussagen des Bundesverfassungsgerichts zu IP-Adressen unter Prämissen, die der Realität „immer weniger entsprechen“. Das Gericht sei davon ausgegangen, dass die Abrufe von Internetseiten nicht registriert werden. Nur in diesem Fall sei die IP-Adresse „verhältnismäßig unsensibel“. Die Praxis sei aber die, „dass die IP-Adresse gespeichert wird“. Selbst wenn man nicht angemeldet sei, speichere Google beispielsweise 9 Monate lang, mit welcher IP-Adresse welche Suchanfragen vorgenommen werden. Vor diesem Hintergrund seien IP-Zuordnungen „höchst sensibel“.

Falsch. Auch ohne IP-Vorratsdatenspeicherung wird unter allen polizeilich bekannten Internetdelikten eine Aufklärungsquote von 71% erzielt (2010).

Diese Aufklärungsquote übersteigt diejenige für nicht im Internet begangene Straftaten bei Weitem (55%). Solange Straftaten im Internet ohne Vorratsdatenspeicherung weit häufiger aufgeklärt werden als sonstige Straftaten, ist es nicht zu rechtfertigen, ausgerechnet im Internet jedes Lesen eines Zeitungsartikels und jede Meinungsäußerung nachverfolgbar machen zu wollen.

Falsch. Auch ohne IP-Vorratsdatenspeicherung wird unter allen polizeilich bekannten Fällen der Verbreitung von Missbrauchsdarstellungen im Internet eine Aufklärungsquote von 76% erzielt (2010).

Die Aufklärungsquote bei Missbrauchsdarstellungen im Internet übersteigt diejenige für nicht im Internet begangene Straftaten (55%) bei Weitem. Solange Straftaten im Internet ohne Vorratsdatenspeicherung weit häufiger aufgeklärt werden als sonstige Straftaten, ist es nicht zu rechtfertigen, ausgerechnet im Internet jedes Lesen eines Zeitungsartikels und jede Meinungsäußerung nachverfolgbar machen zu wollen.

Selbst wenn dies zutrifft, kann eine solche rechtswidrige Praxis keine Maßstäbe setzen.

Das Telekommunikationsgesetz bestimmt seit jeher, dass Diensteanbieter nur die zur Bereitstellung und Abrechnung ihrer Dienste erforderlichen Verbindungsdaten speichern dürfen (§ 96 TKG). Die IP-Adresse darf nicht protokolliert werden, weil das geschuldete Entgelt von ihr nicht abhängt. Der Internet-Zugangsanbieter T-Online speicherte früher dennoch 80 Tage lang, welchem Kunden wann welche IP-Adresse zugewiesen war. Holger Voss klagte erfolgreich gegen die Datenspeicherung, und das Unternehmen wurde verurteilt, die zugewiesenen IP-Adresse mit Verbindungsende umgehend löschen. Der Bundesdatenschutzbeauftragte setzte 2007 allgemein durch, dass Internet-Zugangsanbieter IP-Adressen nicht oder nicht länger als sieben Tage speicherten. So ist es auch heute wieder.

"IP-Adressen müssen wie auch Telefonnummern ihrem Inhaber zuzuordnen sein"

Falsch. Telefonnummern sind mit IP-Adressen nicht vergleichbar. Das Internet ist kein Telefon.

Im Telefonnetz ist die Möglichkeit anonymer Telekommunikation trotz personenbezogener Rufnummern dadurch gewährleistet, dass die Rufnummer dem Gesprächspartner nur auf Wunsch angezeigt wird und man einen Pauschaltarif oder Prepaidtarif mit sofortiger Datenlöschung wählen kann. Im Internet dagegen lässt sich die Übermittlung der IP-Adresse an den Kommunikationspartner und deren Protokollierung dort nicht einfach abstellen. Deswegen ist technisch nicht versierten Normalnutzern eine anonyme Information und Kommunikation im Internet nur mithilfe einer anonymen Kennung möglich.

"IP-Adressen müssen wie auch Kfz-Kennzeichen ihrem Inhaber zuzuordnen sein"

Falsch. Kfz-Kennzeichen sind mit IP-Adressen nicht vergleichbar. Das Internet ist kein Auto.

Niemand schreibt mit, wo man wann mit dem Auto gewesen ist. Im Internet wird dagegen verbreitet jeder Klick und jede Eingabe mitsamt der IP-Adresse protokolliert, so dass die Anonymität von IP-Adressen von zentraler Bedeutung ist. Im Straßenverkehr ist die Möglichkeit anonymer Fortbewegung trotz personenbezogener Kfz-Kennzeichen dadurch gewährleistet, dass man sich zu Fuß, mit dem Fahrrad, mit einer Mitfahrgelegenheit oder mit dem Bus auch ohne eigenes Kfz-Kennzeichen fortbewegen kann. Das Internet kann man demgegenüber nicht ohne eine IP-Adresse nutzen. Deswegen ist technisch nicht versierten Normalnutzern eine anonyme Information und Kommunikation im Internet nur mithilfe einer anonymen Kennung möglich.

Wrong. car licence numbers are not equal to IP-Addresses. The Internet is not a car.

Nobody writes, where one has been when the car. In the Internet it's widespread that every click and each command is recorded together with the IP-Adress. So the "anonymity by IP addresses" is of central importance. In road transport, the possibility of anonymous movement is very easy and common: you can move on foot, by bike, with a ride or bus - there will no personal licence niumber assigned to you. On the other hand, you cannot use the Internet without an IP address. That's why non-technical users are only able to inform themself anonymous if the IP-address remain anonymous, too.
