Evaluation of the EU directive on Telecommunication Data Retention

Background and Information

After the Implementation of the EU-Directive in 2005, the first evalution is planned in 2011. This might be the last chance to repeal the directive. The first evaluation draft from the commission was planned to be published in late 2010. But they are in trouble. The member states were incorrect and did not evaluate the use of the data retention.

Timeline

  • march 2011: The Commission intends to submit its evaluation report and recommendations to the European Parliament and the Council in March 2011. 3rd March is a DG Home internal deadline for publishing the report.
  • march 2011: publication shadow report EDRi
  • march 2011: official start impact assessment by the Commission of various policy options (has already started behind the scenes some time ago - which is insane because the conclusions of the evaluations are still to be determined. But that's Brussels...)
  • ± June 2011: publication impact assessment and proposal for amending directive by Commission (wild estimate)
  • From there onwards: European Parliament and European Council (member states) co-decision procedure, which leads to a final result.
